6 Person Juries Coming to Illinois Civil Cases in June

Outgoing Governor Quinn has approved a bill raising juror pay and cutting the size of juries in civil cases to six persons. Under the present law, a twelve person jury is available in any case seeking damages of more than $50,000, and the defending party nearly always demands a twelve person jury.

The bill is likely to lead to significantly more verdicts in favor of plaintiffs and higher damage awards; it is considerably easier to convince six people to find a defendant liable and award large damages than it is to convince twelve people. However, twelve person juries would remain for criminal cases.
